Welcome to Upstreet Corporation ("Upstreet," "we," "our," "us"). These Terms of Service ("TOS") govern your use of our AI agent service. By accessing or using our services, you agree to comply with and be bound by these TOS.
Upstreet provides a platform where users can pay for autonomous agents to perform tasks as implemented and requested by the user. These agents are designed to operate autonomously based on user specifications.
You are solely responsible for the actions and outputs of the autonomous agents you utilize through our service. You agree not to use our services for any illegal activities. Any misuse or illegal activity conducted through our services will result in immediate termination of your access.
We reserve the right to terminate or suspend your access to our services at any time, without notice, for conduct that we believe violates these TOS or is harmful to other users, us, or third parties, or for any other reason in our sole discretion.
We provide open source software used in the development and deployment of the agents. This software is provided "as-is," without any warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the fullest extent permitted by law, Upstreet shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the service; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from our services; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our services by any third party; (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the services; and/or (vi) the defamatory, offensive, or illegal conduct of any third party.
These TOS and any disputes arising out of or related to these TOS or our services will be governed by the laws of the State of Delaware, without regard to its conflict of law principles.
